Real Estate Registration as a Document for Proving Property Ownership: A Comparative Study

Abstract

The primary aim of laws is to secure transactions, prevent fraud, and avoid the resulting loss of rights and funds as well as frequent disputes. Among the means to achieve permanent and continuous stability of property ownership is to make ownership rights firmly established through a set of tools that serve as a basis for identifying properties, such as the real estate registration in Morocco and the land register in Algeria.

      The regulation of documents proving property ownership varies from one country to another; some grant them absolute authority, as is the case in Morocco, while others adopt relative authority, as followed by the Algerian legislator.
